FAILURE OF TSTT’S PUBLIC GSM MOBILE TELECOMMUNICATIONS NETWORK

The Telecommunications Authority of Trinidad and Tobago has written the Telecommunications Services of Trinidad and Tobago (TSTT) regarding failures in the public GSM mobile telecommunications network during the week commencing July 10 th, 2005. The letter, addressed to Mr. Carlos Espinal, TSTT’s Chief Executive Officer, reads:

 

Dear Mr. Espinal,

 

Failure of TSTT’s Public GSM Mobile Telecommunications Network during the week commencing 10 July, 2005

 

We refer to the TSTT public GSM mobile telecommunications network. The Authority is concerned to note that the network was subject to persistent failures during the week commencing on 10 July, 2005, resulting in unsatisfactory mobile telecommunications services during that period.

These failures constitute the second occasion in less than two months that the TSTT network has failed for an extended period of time. In this regard the Authority refers to its letter of 2 June, 2005, which related to the failure of the network between 31 May and 1 June, 2005. In response to that letter TSTT assured the Authority by letter dated 8 June, 2005 that it was “… very concerned that there is no repetition of the service interruption and so we have postponed another switch upgrade to ensure that all network improvements and ‘quality assurance’ of the process is certified by C&W in order to achieve the badly needed upgrade to meet capacity requirements, without major service degradation to our customers.” It is the view of the Authority that a major service interruption within such a short timeframe following such a commitment is unacceptable.

To date, TSTT has failed in respect of either the service interruption of 1 June, 2005 or the interruptions the subject of this letter, to:

  • provide a satisfactory explanation to the public or the Authority;
  • provide a clear commitment and institute measures to avoid the recurrence of such interruptions; or,
  • provide adequate compensation to affected users.

 

Pursuant to Section 18(1)(m) of the Telecommunications Act, 2001 the Authority now requests that TSTT submit within 7 working days of the date hereof a complete report containing, as a minimum, the following:

  • A detailed explanation for the network failures during the week of the 10 to 17 July, 2005.
  • Details of the measures which TSTT has taken or proposes to take in order to prevent such occurrences in the future.
  • Proposals by TSTT to provide adequate compensation to its customers for the network failures of 31 May to 1 June, 2005, and during the week of 10 to 17 July, 2005, and an outline of TSTT’s policies for compensation for any future service interruptions.
  • Clear procedures for prior notification of the public of all planned service interruptions, and timely notification of any unplanned service interruptions.
